Thank you for purchasing a product from TravelBrisk Limited. Card purchases made through our online checkout are processed by Armitage Labs OÜ, trading as Creem ("Creem"), which acts as the merchant of record and authorised reseller for the purchase. Purchases invoiced by TravelBrisk Limited and paid by bank transfer or a local payment provider are sold by TravelBrisk Limited directly. This policy details when you may be entitled to withdraw a transaction and/or receive a refund, and how to request one. It applies to transactions completed by consumers and by businesses.
If local consumer protection laws provide you with additional or non-waivable rights, the highest level of rights will always apply. Nothing in this policy limits your mandatory consumer rights. For purchases processed by Creem, this policy operates alongside Creem's Buyer Terms; if there is any inconsistency, Creem's terms apply to that purchase.
1. Refund policy
- Unless required by applicable law, all transactions are non-refundable and non-exchangeable.
- A refund may be issued on a discretionary basis (see section 7) or if you exercise an applicable statutory withdrawal or refund right (see section 2).
- Refunds will not be issued where there is evidence of fraud, refund abuse or other manipulative behaviour.
- This policy does not affect consumer rights in relation to products that are not as described, faulty or not fit for purpose (see section 4).
- Refund requests must be made within the applicable statutory or discretionary period described below.
- If you receive a refund in accordance with this policy, access to the relevant product will cease.
2. Country-specific rules
Where local consumer protection laws grant unconditional "withdrawal" rights, those rights apply and override this policy. Where regional differences apply, the highest standard of protection across the relevant country is applied, as reflected below.
European Union, EEA, Switzerland and United Kingdom
- Consumers have a 14-day statutory right to withdraw from some digital content and service contracts and receive a full refund.
- The right to withdraw applies to one-off purchases and to the first payment under a subscription contract. It does not apply to subsequent subscription payments, except as described in the next point. If a subscription includes a free trial period, then as soon as that free trial period ends you will again have 14 calendar days to exercise your right to withdraw.
- If you completed a transaction in the UK and have an annual subscription, you will have a new period of 14 calendar days to exercise your right to withdraw, starting on the day the subscription auto-renews for another year.
- The right to withdraw does not apply to the supply of digital content that has started to be downloaded, streamed or otherwise used, where you have given express consent to waive your withdrawal rights.
- To exercise this right, request a refund within 14 days of the date of the transaction (see section 3).
Turkey and Israel
- Consumers have a 14-day statutory right to withdraw from some digital content and service contracts and receive a full refund.
- To exercise this right, request a refund within 14 days of the date of the transaction (see section 3).
South Korea, Brazil and China
- Consumers have a 7-day unconditional right to cancel digital content or service contracts after delivery and receive a full refund.
- To exercise this right, request a refund within 7 days of the date of the transaction (see section 3).
Canada
- Consumers have a 7-day unconditional right to cancel digital content or service contracts after delivery and receive a full refund.
- To exercise this right, request a refund within 7 days of the date of the transaction (see section 3).
- You acknowledge having received access to a French version of this policy. Vous reconnaissez avoir reçu une version française de cette politique.
Singapore
- Consumers have a 5-day unconditional right to cancel digital content or services after delivery or first access and receive a full refund.
- To exercise this right, request a refund within 5 days of the date of the transaction (see section 3).
3. How to withdraw, request a refund or cancel
Withdrawal
EU, EEA, Swiss and UK consumers may exercise a right of withdrawal during the 14-day withdrawal period using any of the methods listed under "Refunds" below. If you withdraw within the withdrawal period, you will be refunded within 14 days of the request being received.
Refunds
To request a refund, use one of the following methods:
- email support@travelbrisk.com with your invoice number, or reply to the receipt sent to your email when you paid;
- for a card purchase processed by Creem, if we have not resolved your request, contact Creem through the Customer Portal link in your Creem receipt or at support@creem.io;
- for a purchase invoiced by TravelBrisk Limited and paid by bank transfer or a local payment provider, email support@travelbrisk.com with your invoice number. The same rules and timelines in this policy apply.
Cancellation
To cancel a subscription, use one of the following methods:
- cancel from the billing page of your TravelBrisk account;
- email support@travelbrisk.com.
Cancellation takes effect at the end of the applicable billing period and prevents any further payments from being taken. If a transaction is not eligible for a refund, you may still cancel the subscription at any time to prevent future billing.
If eligible, refunds are processed using the same payment method where possible and within 14 days of approval of the request (withdrawals are refunded as described under "Withdrawal" above). Transaction records are used to verify eligibility and timing but do not override your statutory rights. If you are not sure of the details of your transaction or whether you are eligible for a refund, contact us and we will do our best to help.
4. Refunds for technical or product defects
If you experience persistent technical issues with the product you purchased, or a material defect that prevents you from accessing the features or benefits as described:
- contact TravelBrisk support first, at support@travelbrisk.com, to attempt to resolve the issue or request a refund;
- if the issue cannot be resolved and you paid by card through Creem, contact Creem's support team (see section 3) and provide details of the issue and any response received from us;
- where there is evidence of a material technical or product defect, a refund will be issued in accordance with applicable consumer protection laws.
5. Add-ons and one-time transactions
- Add-ons linked to a main subscription expire when the main subscription ends, unless otherwise stated.
- Refund eligibility for add-ons and one-time transactions follows the same criteria as the main transaction, unless local law provides otherwise.
- Items that are delivered and fully accessible immediately may be non-refundable once delivered, except where required by law.
6. Chargebacks and payment disputes
- We encourage you to contact us, or Creem for a card purchase processed by Creem, before raising a chargeback or a dispute with your bank, card issuer or other payment provider.
- If you initiate a chargeback or payment reversal, access to the relevant product may be temporarily suspended while the matter is reviewed.
- On receipt of the chargeback or dispute, the payment provider will be given the payment details and, where relevant, your consent to waive statutory rights.
- This does not affect your lawful rights to dispute a charge under card-scheme or consumer-protection rules.
7. Discretionary refunds
- A refund may be issued at our sole discretion, or Creem's for a purchase it processed, if a request is submitted within 14 days of your transaction date. Submission of a request within this 14-day period does not guarantee a refund.
- All refund requests are reviewed on a case-by-case basis, considering relevant factors including the nature of the product, the reason for the request, usage or consumption, and any applicable contractual terms. A refund may be approved in full, approved in part, or declined.
- Any discretionary refund granted is voluntary and does not create an obligation to provide refunds in the future, including for similar requests, and does not waive any rights or remedies under applicable agreements or law.
8. Updates to this policy
This policy may be updated from time to time. The version in effect at the time of your transaction governs that transaction. We recommend saving or printing a copy for your records.
9. Governing law and resolving disputes
For purchases processed by Creem, this policy is subject to the governing law, complaints and disputes provisions set out in Creem's Buyer Terms. For purchases invoiced directly by TravelBrisk Limited, the governing-law and disputes provisions of our Terms of Service apply.
10. Travel booked on an agency's website
Travel agencies use TravelBrisk software to run their own websites and booking portals. A flight, hotel, package or insurance policy booked on one of those sites is a purchase from that agency, not from TravelBrisk Limited, and is governed by the agency's terms and the supplier's conditions. See Refunds for travel bookings.
